Müharibə əsiri və ya hərbi əsir — silahlı münaqişə zamanı və ya dərhal sonra döyüşən dövlət tərəfindən saxlanılan şəxs. "Müharibə əsiri" ifadəsinin ən erkən qeydə alınmış istifadəsi 1610-cu ilə aiddir.
Döyüşçülər müharibə əsirlərini hələ də meydanda olan təcrid etmək (döyüş əməliyyatlarından sonra nizamlı şəkildə azad etmək və geri qaytarmaq), hərbi qələbə nümayiş etdirmək, cəzalandırmaq, müharibə cinayətlərinə görə cinayət məsuliyyətinə cəlb etmək, onları əməkləri üçün istismar etmək, onları öz döyüşçüləri kimi işə götürmək və ya hətta hərbi xidmətə çağırmaq, onlardan hərbi və siyasi kəşfiyyat məlumatları toplamaq və ya onlara yeni siyasi və ya dini inanclar aşılamaq kimi bir sıra qanuni və qeyri-qanuni səbəblər əsasında əsirlikdə saxlayırlar.
1949-cu il Cenevrə Konvensiyalarına əsasən, bəzi və döyüşdən kənar olan düşmən döyüşçülər ilə yanaşı hərbi əsirlərə avtomatik olaraq statusu verilir.
